1. General Provisions

These Terms and Conditions ("Terms") govern the purchase of products from the online store Cloud & Cottage (the "Store"), operated by SM Online Group OÜ.

By placing an order in the Store, the customer ("you," "buyer") confirms that they have read, understood, and agree to these Terms.

2. Products and Prices

  • All product descriptions, images, and prices displayed in the Store are as accurate as possible, but minor deviations (e.g. slight colour variation due to screen settings) may occur.
  • All prices are listed in euros (EUR) and include Estonian VAT, unless stated otherwise.
  • Delivery costs are shown separately during checkout, before the order is confirmed.
  • We reserve the right to correct pricing errors and to change prices at any time; changes do not affect orders already confirmed.
  • Some products are custom-made or made to order based on your specifications (e.g. fabric width, size, or personalization).

3. Placing an Order

  1. Add the desired products to your cart and proceed to checkout.
  2. Enter your delivery and contact details, and choose a payment method.
  3. Review your order and confirm it. A binding sales contract is formed once payment is successfully completed.
  4. You will receive an order confirmation by email.

4. Payment

  • Payments are processed securely through our payment provider, Montonio.
  • Accepted payment methods include bank links, credit/debit cards, and other options offered by Montonio at checkout.
  • We do not store your full payment card details; these are handled directly by the payment provider.
  • Your order will be processed only after payment has been successfully received.

5. Delivery

  • We deliver via Omniva, DPD, or SmartPosti, depending on the option selected at checkout.
  • Estimated delivery times: 2–5 business days within Estonia; 3–14 days for other EU countries, up to 21 days worldwide.
  • Delivery areas: Worldwide.
  • Risk of loss or damage passes to you once the goods have been delivered to the address provided at checkout.
  • If a delivery is delayed significantly, we will notify you by email as soon as we become aware of it.

6. Right of Withdrawal (14-Day Return Right)

In accordance with EU consumer protection law, if you are a consumer purchasing for personal (non-business) use, you have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason.

To exercise this right:

  • Notify us in writing (email to info@cloudandcottage.com) within 14 days of receiving your order.
  • Return the goods to us within 14 days of notifying us of your withdrawal, in their original condition and packaging where reasonably possible.
  • Return shipping costs are borne by the customer, unless the goods are faulty or incorrect.

We will refund the full purchase price (including standard delivery cost) within 14 days of receiving the returned goods or proof of return, using the same payment method used for the original order.

Exceptions to the right of withdrawal (per Estonian Law of Obligations Act §53(4), implementing EU Directive 2011/83/EU), the right of withdrawal does not apply to:

  • Goods made to your specifications or clearly personalized (e.g. custom sizes, engravings, monograms)
  • Goods that deteriorate or expire quickly
  • Sealed goods unsuitable for return for health or hygiene reasons, once unsealed after delivery

7. Warranty and Liability for Non-Conformity

  • All products come with the statutory 2-year liability for non-conformity under the Estonian Law of Obligations Act.
  • If a product is faulty, damaged in transit, or does not match its description, please contact us at info@cloudandcottage.com with your order number and a description (and photos, if possible) of the issue.
  • Depending on the situation, we will offer a repair, replacement, price reduction, or refund, in accordance with Estonian consumer protection law.

8. Complaints

If you are not satisfied with a product or our service, please contact us first at info@cloudandcottage.com so we can resolve the issue directly.

If we cannot reach a resolution, you may submit a complaint to:

  • The Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon), via the Estonian Consumer Protection and Technical Regulatory Authority — www.ttja.ee
  • The EU Online Dispute Resolution (ODR) platform — ec.europa.eu/consumers/odr

9. Intellectual Property

All content on the Store — including text, images, logos, and design — is the property of SM Online Group OÜ or its licensors and may not be copied, reproduced, or used without prior written permission.

10. Limitation of Liability

To the extent permitted by law, SM Online Group OÜ is not liable for indirect, incidental, or consequential damages arising from the use of our products or website. Nothing in these Terms limits any liability that cannot be excluded under applicable consumer protection law.

11. Force Majeure

We are not liable for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including natural disasters, strikes, transport disruptions, or other unforeseeable events.

12. Changes to These Terms

We may update these Terms from time to time. The version published on the Store at the time of your order will apply to that order.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes will primarily be resolved through negotiation, and if unresolved, through the Estonian Consumer Disputes Committee, EU ODR platform, or the competent Estonian courts.
